This document, authored Robin Morgan Pelteret of Cape Town, South Africa, is constituted of his research into the origins of a family into which he married, namely the family Kotzee (Kotzé) of Winburg, Orange Free State, South Africa.

Background to the KOTZEE / KOTZÉ Family origins

The First record of the Kotze family is dated the year 1234. In the century that followed, a Hermann Kotze attained the privilege of knighthood and became the owner of valuable estates inclusive of the fortified castle at Ammendorf. By the fifteenth century, his grandson, Hans Kotze, was possessed of huge tracts of land; was lord of several manors and seignories, including the castle of Gross Germersleben, near Magdeburg. This he acquired in the year 1489 and it became the chief seat of the head of the house of Kotze.

The representatives of this family occupied various positions of trust and importance, mostly in the military profession, as befitted the gentlemen of those days. We read of no less than four

sons of another Hans Kotze, a descendant of the Hans above-mentioned, valiantly fighting under Conde against Alva in France and the Netherlands and eventually falling on the field of honour in 1567-8.

The family is first well documented when living in Saxony.

The name of Kotze is not derived from any place or locality; and this may explain, as the "Urkunden Regesten" suggests, why the preposition "von" was not at first prefixed to the family name.

Until the early part of the 18^th century, the name was written without the preposition “von” [“Urkunden Regesten der Herren v Kotze”, Magdenburg, 1866; 1-2].

The name Kotze(e) appears to be a contraction or abbreviation of KOTSASSE, that is “a small brother”.

The original signification of the word "Kotze" is a woollen covering such as a blanket or an overcoat or covering mantle. Hence the shield of the family coat of arms contains the full figure of a man, dressed in a long black woollen coat.

The coat of arms bears a man with arms outstretched (in silver) in official attire. On the helmet carries a sitting Greyhound. The motto is “Fortiter en Fideliter”.

A member of this family, Jan Kotze of Königstein, Saxony, settled at Buyksloot near Amsterdam, where he was a burgher and merchant. He is the Founding Father of the Kotzee family in South Africa.

He was married four times, variously to:

On the 1st January, 1690 he married Hildegonda Boone (b 23 November 1662 d 22 August 1702), daughter of Dirk Boone, minister of the Church at Rotterdam, and of Beletje van Galen, sister to the famous Dutch admiral, Jan van Galen, who destroyed an English squadron in 1653 off Livorno. Some time after this marriage, Jan Kotze left with his wife for the Cape in the ship "Pampas", and reached Table Bay on the 13th May, 1691. In the following year their son Dirk was born.

Jan Kotze went back to Europe in 1698, settled his affairs and returned to the Cape in 1701. In August of the following year his wife died, and in January, 1704, he remarried, his second wife being Hendrika van Hoeting. Out of this marriage two sons, Hendrik and Jan, were born.

This second marriage of Jan Kotze in January, 1704, is recorded as the first marriage that took place in the newly built and first Dutch Church in Adderley Street, Cape Town, to become known later when re-built simply as “Die Groote Kerk”.

The family line of Victor Serrurier Kotzé was to disperse slowly from Winburg, Orange Free State from the 1970’s onwards, having arrived in Winburg over generations via the Swartland (Stellenbosch), Graaff-Reinet, Colesberg, Fauresmith, Smaldeel (Theunissen) and thence Winburg. They had lived in the Winburg district for approximately 150 years. Before the South African Anglo-Boer War (1898-1902), they appear to have been quite affluent farmers both when considering their own estates and those of their near relatives, the Erasmus Family.

Thus far, it is not clear as to the activities of Johannes Albertus Kotzee (V S Kotzé’s grandfather) during the South African Anglo-Boer War (1898-1902) that it is likely that he was “on commando”. Various cousins Erasmus are known to have participated in the fighting on the side of the Oranje Vrij Staat Commandos. However, only Lourens Daniel Erasmus (a younger brother of J A Kotzee’s wife, Johanna Aletta Erasmus) received as acknowledgement of his influential membership of the Winburg Commando, the Dekoratie voor Trouwe Dienst - DTD. I suspect that a number of family members had died by the time the DTD, the Oranje Vrijstaat Oorlogsmedalje and Lint voor Verwonding opgegaan gedurende de Anglo-Boeroorlog was promulgated (21^st December 1920), and that the rest didn't bother or, less likely (but, as was the case with many people), were unaware of the existence of the decorations.

Lourens Daniel Erasmus fought under General C R de Wet and was considered extremely courageous. Gerhardus Cornelius Erasmus was less so, being nicknamed “Kommandovoël”, being shrill of voice and talkative by temperament.

In researching the family Kotzee (Kotzé), the importance of the family Salomon Jacobus Petrus Erasmus (Death Notice E.771) of “Allermanskraal” (and several other farms) and the effects of the South African War (1899-1902) on the family fortunes cannot be over emphasised.

There were forty (40) first-and second-generation descendants resulting from his marriage. One of his daughters, Johanna Aletta Kotzee (neé Erasmus) married J A Kotzee. With S J P Erasmus’s death, a substantial estate was distributed amongst an extensive family. From the perspective of this historical research, this had several consequences:

1) The descendants alive at the time of his death were catalogued in the estate. This assisted in building up the Erasmus, and through them, the Kotzee, family trees

2) In order to legally claim on the estate, it became important that the deaths which took place during the Anglo-Boer War be officially acknowledged through registration. This was accomplished in a dogged fashion over a great many years, firstly by J A Kotzee, and later by S J P Kotzé, his son. Over this period, we see the spelling of the family name change from Kotzee (used for two centuries) to Kotzé.

3) Further, following devastating losses in human life through disease and famine and the immense and systematic destruction of fixed property and livestock, draconian taxes and an often petty, certainly inefficient, bureaucracy complicated people’s lives and impeded the rehabilitation of rural Afrikaans and Black communities. All these aspects are perceived in the history of the Kotzees of Winburg.

Gerhardus Petrus Kotzee originally of Graaff-Reinet was the founding father of the several branches of the Kotzé family found in the Hoopstad and Winburg districts. Married to Hester Sophia Nieman(d), he settled on “Kareeboomfontein” in about 1840 and died there in 1875. The couple produced 14 children, most being born in Colesberg.

His sixth son, Pieter Jacobus Kotzee, born in Colesberg, married a Sara Jonanna Louw (Ockert) of Fauresmith. He was given as living on “Kareeboomfontein” in 1901 when he was interned in the Brandfort Camp for Women, together with other family members (his younger female children - the siblings of J A Kotzee, and some of his grandchildren - the children of J A Kotzee).

Prior to the 7 October 1901, Salmon Jacobus Petrus Kotzé had seen his mother buried on the 6 May 1900 “the day the British arrived” (they first took occupation on the 3 May 1900). This tragic event was to be followed by the death of four (4) of his siblings between October 1900 and December 1901.

One of the greatest difficulties experienced in this research has been related to Johannes Albertus Kotzee, married to J A Erasmus and father of S J P Kotzé. The State Archives Cape Town, Bloemfontein, Pretoria and the self-same Master’s Offices, thus far have found no records whatsoever of his existence except for documents relating to an insolvent estate K81. They may well have been destroyed, for after 10 years this is routine in some centres in the case of “rehabilitated insolvents”. So, despite our knowing that he ran a guest house in Ficksburg, died in 1937 and that his grave is in the Memorium Cemetery, Bloemfontein, no death notice has been unearthed as yet.

Ones intuition suggests that J A Kotzee was a spendthrift or maladroit at managing money; and as a result serial difficulties arose around the settling of the estates of his mother (of whose estate he was executor), father (from whose estate he was excluded, but from which he raised loans), grandfather (Erasmus, from whose estate he was excluded together with a cousin, Solomon Jacobus Petrus Erasmus) and his daughters (who died during the war intestate).

The tales of him as warm. He is described as “an adventurer”, as being remembered “walking about the farm (Taaibosch) in black suit with collar and tie and magnifying glasses making ‘discoveries’ as he went”; as “taking part in various mineral schemes”; as having “discovered the Free State Goldfields”; as having detected a “diamond-bearing fissure on Taaibosch, near the homestead” ~ the probable origin of some of the diamonds in the possession of the family to this day.

And what of the family name? The spelling of the family name changes from Kotzee as reflected last in 1912 (in the document Master of the Supreme Court re: Johannes Albertus Kotzee) to finally Kotzé in 1916 (in the hand of Salmon Jacobus Petrus Kotzé).

WINBURG, ORANGE FREE STATE, SOUTH AFRICA

Winburg was the first town established by the Voortrekkers (“pioneers”) in the Oranje Vrij Staat (later Orange River Colony, Orange Free State and Free State), and the second after Philippolis in the province. In 1935, Andries Hendrik Potgieter (a well-to-do farmer from the Tarka and Colesberg areas of the Cape of Good Hope), and a group of eleven settlers, was ceded the rights to a strip of land between the Vet and Vaal Rivers by Makwana, a local black African chief of the БaTaung people, in exchange for protection from the maTabele and 42 head of cattle.

The site for a town was chosen in 1842 and named Winburg (originally Wenburg or “victory town”)thus enshrining in history a reminder of the prolonged argument that was enjoined with regard to the most appropriate position for the new town. The site nominated by the losers to this day is called Mompeling (“muttering”).

Before 1843 Winburg formed part of the Republic of Natalia (Port Natal, Pietermaritzburg, Potchefstroom, Winburg); and no documents of the landrost (“magistrate”) of Winburg prior to that date are known to exist, archival record sequences existing from 1848 onwards. The oldest baptismal, church membership and marriage registers of Winburg are dated 1842 and are housed in Bloemfontein. In 1843, Natal was annexed to the Cape of Good Hope. In 1846, the governor of the Cape appointed a British Resident to look after “the interests” of the trekboers; and in February 1848, Sir Harry Smith annexed the entire region between the Orange and Vaal Rivers under the British Crown as the Orange River Sovereignty. The Free State was recognised as independent, sovereign territory by the British in 1854 and it remained thus until the Second Anglo-Boer War. All documents covering the period of British rule resided in the Cape Archives until 1927 when they were transferred to the Free State.

Winburg is a classic Free State town. It lies 110 kilometres north of Bloemfontein, surrounded by low hills and plains of golden, highveld grassland and Acacia species. A large central square is dominated by a Dutch Reformed Church, a town hall, stores, an hotel and offices. Much of the architecture is classical and dates from the early 20^th century. A synagogue, Masonic and regimental halls, Roman Catholic and Methodist churches, an open-air market, orphanage (estab.1902) and the town’s residences are built along tree-lined roads which radiate from the town square.

Sites of historical interest include the Dutch Reformed Church designed by John H Till (1898) with a cornerstone laid by the then President of the Oranje Vrij Staat, M T Steyn (1899), and built by van Rundle, Row and Marshall for about £21,000 (it was only completed in 1904 as a consequence of the South African War 1899-1902 which intervened); a Voortrekker graveyard in Brand Street; a South African War graveyard on the south-western outskirts of the dorp (“town”) and a Voortrekker Monument (built 1968) to the south.

As with so many dorps in rural South Africa, the development of a National highway network which by-passed the town brought with it a slow but steady decline in the commercial fortunes of its citizens. To-day, a once proud and vibrant capital of the province, though still a magisterial district and regional agricultural centre, is but a shadow of its former self.

WILLS and INHERITANCES

Sara Jonanna Louw (do. Ockert Johannes Albertus Louw and Sarah Johanna Nieman) L887 (b Philippolis 23 January 1844 d Smaldeel 24 March 1901). The executor was her son, Johannes Albertus Kotzee. An inventory of the joint estate showed ownership of a portion of erf 60, Winburg at £75, cash £114, “Kareeboomfontein” (sold to Marthinus van Rooyen) £3000, promissory note of £26, with liabilities of £980. The residuum of £1069 was divided between the surviving spouse and eight children. However, the authorities discovered that 480 sheep and goats had been sold to a Mr W Holland in September 1901 for an undeclared £123.17.6 (later reduced to £85). All the sheep and goats were subsequently confiscated and/or destroyed by the British troops, but the £85 was still accrued (through a supplementary liquidation account)to the estate. “Certain claims for compensation were made up and handed in” and, if successful, were intended to be incorporated in a further liquidation account.

Pieter Jacobus Kotzee b 27 March 1837 bapt. Colesberg 7 May 1837 d 9 October 1904 K1405. Will written at “Kareeboomfontein” and lodged a month prior to his death, 6 September 1904. He left ¼ of his estate to Jacobus Gidion(sic) Kotzee and ¾ to Petrus Jacobus Kotzee (thus excluding his son, Johannes Albertus Kotzee), with David Gerhardus Roux, Justice of the Peace, Winburg, as executor testamentary and guardian of Petrus Jacobus Kotzee (minor) “to be properly educated and brought up in a Christian manner”. The estate constituted erf. 60, Winburg (sold to a R V Acton) at £95 and live stock etc. totalling £351 less minor liabilities. An error of £1 detected by the Master of the High Court in the drawing up the final liquidation account was borne by the executor (stating “……… I would prefer to bear the loss thereof to redrawing the Liquidation Account”). This estate could only be settled finally in 1906/7 once the final liquidation account of Sara Jonanna Kotzee (neé Louw) was agreed to by the Master of the High Court.

The overwhelming impression gained from the various papers is one of bureaucratic incompetence and pettiness to the point of vindictiveness by the new British administration.

Johanna Aletta Kotzee (neé Erasmus) was born at Uitenhage in 1868 and died in the child-birth of her twins on 6 May 1900 E 379. She was sworn as dead on 24 September 1900 by J A Kotzee (husband). They were married in community of property and drew a joint will dated 28 December 1891. Written in the meticulous and educated hand of Johannes Albertus Kotzee, it listed “Afgunspan” in the district Winburg as their only possession. Later, on her death, the inventory of her estate listed the undivided portion of “Bultpan” No.336 district of Hopetown at £8000 and some livestock at £83 as their joint property. Officially, at that time they were living on erf.91, Winburg, then owned by S J P Erasmus E 771.

When she died, Petrus Jacobus Kotzee and his Salmon Jacobus Petrus Kotzé were on “Allermanskraal” (the home of SJP Erasmus, their grandfather). They walked from there to Winburg to attend their mother’s funeral, PJK carrying SJPK, then 6 years old, the last 5 kilometers. Later, the homestead at “Allermanskraal” was to be destroyed by the British and the family moved to Winburg.

Salomon Jacobus Petrus Erasmus and Hester Susanna Erasmus (neé Oosthuÿhuizen).

On 1 February 1901, S J P Erasmus died. The Joint Will and Testament of Salomon Jacobus Petrus Erasmus E.771 and Hester Susanna Erasmus (neé Oosthuÿhuizen) was drawn up in English on 4 May 1898. The details in the main are :

Allermanskraal No.46 left in equal part to Gert Cornelius Erasmus and Lourens Daniel Erasmus ; each of whom have to pay £200 to Susanna Salomina Vermaak (neé Erasmus)(deceased) and Cornelia Elizabeth Rudman (neé Erasmus)

Taaibosch No.43 left in value to Johanna Aletta Kotzee (neé Erasmus) and Hester Susanna Petronella Erasmus E.848

Ventersrust No.735 left to Hester Magdalena Potgieter (neé Erasmus)

Mainreef No.842 left to Solomon Jacobus Petrus Erasmus who “may not sell, exchange, give or in anyway alienate or mortgage” and upon his death will transfer it to his natural children.

Lekkerlewen No.423 left to Abel Hermanus Christiaan Erasmus and Johannes Martinus Andries Erasmus ; each of whom have to pay £300 to Susanna Salomina Vermaak (neé Erasmus)(deceased) and Cornelia Elizabeth Rudman (neé Erasmus)

# with life-long usufruct on the farms to the surviving spouse and maintaining the full ownership of the estate and giving expression to full power of the Will only after the death of the last surviving

# with the survivor paying for the studies (in Theology) of Johannes Hermanus Erasmus out of the moveable portion of the estate

and, in the case of Allermanskraal, Lekkerlewen, Taaibosch and Ventersrust, the farms may be sold to strangers provided that they have been offered first to members of the family at market-related value an, in turn, declined

Erf No.91, in the town of Winburg bequeathed to each other mutually.

The value placed on the Estate was £10786.14.9. The first liquidation account was published on 14 August 1903, followed by one for £235.1.6 on 29 January 1906. The First Liquidation and Distribution Account is dated 9 January 1903; the final, the 29 January 1906.

This will was to cause great distress within the immediate and extended family. This related to a number of issues :

1. certain male beneficiaries had to find considerable sums of money to pay out female beneficiaries. Those that were left land with a responsibility for providing the cash to be disbursed experienced great hardship in an attempt to retain (as they were obliged to) the land; and clearly this led to disharmony. There was an insistence by beneficiaries in having land surveyed and subdivided, or neighbours in having lands fenced. In the absence of sufficient liquid assets, over two decades, these matters were referred repeatedly to the High Court of the Orange River Colony in Bloemfontein for resolution.

2. it was not viable to hold certain lands either in whole or subdivided, and permission had to be sought from the High Court to sell them - contrary to the terms of the will.

3. the manner in which monies and/or properties were managed and distributed on the death of certain named beneficiaries of the original will of E.771 led to dispute and, once again, a flight to law for a decision. This added to the sizable financial burden.

4. in the end, the considerable wealth of E.771 was essentially dissipated, being divided into almost trivial bequests of ever decreasing amounts.

With respect to these issues, the Kotzee family was not immune.

She received one-fifth undivided portion of “Taaibosch” No.43 formerly owned by Salomon Jacobus Petrus Erasmus E771. Life-long usufruct passed to Hester Susanna Erasmus (neé Oosthuÿhuizen).

Johannes Albertus Kotzé K1855 died 17 November 1900. Sworn as dead on 5 May 1916 by S J P Kotze (brother). Here is found the first spelling of name as Kotzé. This child predeceased E771. There appears to have been no distribution from E771 in favour of this child and, through him, J A Kotzee (father).

Gert Cornelis Kotzé K1856 died 16 October 1900. Sworn as dead on 5 May 1916 by S J P Kotzé (brother). The first spelling of name as Kotzé. This child predeceased E771. There appears to have been no previous distribution from E771 in favour of this child and, through him, J A Kotzee (father).

In July 1909, Gordon Fraser and Mc.Hardy of Bloemfontein “are instructed” (by whom, not stated; but it was the Erasmus Family) to seek a ruling from the Master of the Supreme Court with regard to whether it was correct that J A Kotzee (spouse and father), at that time living with his “new” family at “Vrijheid” : P O Klippan, in the district Hopetown, had inherited a two part share of “Taaibosch” from his children K1669 & K1770 who were not mentioned in E771 and themselves died intestate after E771.

In 16 May 1911, Gordon Fraser and Mc.Hardy of Bloemfontein make application for the surrender of the Insolvent Estate of J A Kotzee K81. Sole assets quoted were the inheritances from Johanna Aletta Kotzee K1669 and Sarah Johanna Kotzee K1670. It was filed 8 November 1912. Outcome unknown.

Another (undated) document exists showing monies were recovered from K1670 and (father) Johannes Albertus Kotze. The outcome was payment of £77 to three survivors, brothers and sister.

Hester Susanna Kotzé applied for her inheritance on 4 February 1915 (age 22 yrs). For the first time, the signature on the document reflects the spelling of the family name as being “ Kotzé ”. (signatures “ Kotzé ”)

Salmon Jacobus Petrus Kotzé b 20 April 1895 claimed his portion of this estate in 1916. It was granted once it was certified that his mother, aunt and four siblings were dead (E379; E848, K1669; K1670; K1836; K1855). Here again, the signatures on the documents reflect the spelling of the family name as being “ Kotzé ”.

Portions of “Taaibosch”, which had been “retrieved” for the minor children by the legal action of the Erasmus Family, were inherited by each of Petrus Jacobus Kotzee, Hester Susanna Kotzé (150 morgen) and Salmon Jacobus Petrus Kotzé (“Idalia” of 150 morgen). PJK later bought out his siblings. Until they reach majority, the Erasmus’s took full responsibility for these three children, PJK and SJPK being raised by their uncles Daan, Gert and Jan; and HSK by her redoubtable and greatly revered grandmother.

The deaths of Johanna Aletta Kotzee (neé Erasmus) E379 and Hester Susanna Petronella Erasmus E848, each of whom possessed their own property and inherited further from E771 added to this confusion.

I suspect that the action was brought against Johannes Albertus Kotzee (JAK : the father) through the Orphan Chamber by the Erasmus Family or one (or all) of the three surviving children, namely Petrus Jacobus Kotzee (Kotzé)(PJK : then 17 yrs), Hester Susanna Kotzee (then 16 yrs), Salmon Jacobus Petrus Kotzé (SJPK : then 14yrs), who were the only children mentioned in the death certificate of S J P Erasmus (SJPE) E771 and thus possibly thought to be the only ones alive on the date of his death, 1 February 1901. However, the girls, K1669 and K1670 were in the Brandfort camp as was PJK and SJPK. The death dates of K1669 and K1670 post-date that of E771 so one should think that, in terms of the wording of the will of SJPE E771, they should have inherited together with their surviving siblings and, through them (dying as they did intestate), their father. It appears highly improbable that JAK, on enquiry of the Master of the High Court or the Orphan Chamber, misrepresented the dates of death on the certificates dated 4 July 1911 as the same death date for K1670 appears in the Brandfort camp register written in the same hand as the original family entry in the register. Thus, recovering monies from JAK, and, in the process, declaring him insolvent, would appear to have been an unfortunate decision.

Mainreef No.376 district Ventersburg (MR2). Inherited by Salomon Jacobus Petrus Erasmus, to be passed on to his six children. A application to the Supreme Court dated 9 April 1907 asks for this bequest to be waived and permission granted for a sale as the property as “useless” and “without water”, for the Orphan Chamber to hold the money until a better property could be identified for purchase. From MR2 it is evident that the viability of running this farm diminished immensely once access to the Rietspruit was denied by its separation from Ventersrust

These portions of the farms belonging to the estate later needed formal consolidation with Ventersrust and Lekkerlewen.

On 8 December 1902, Johannes Albertus Kotzee received and signed for bonded rations to the value of £55. These were made up of mealie meal, mealies, flour, sugar, coffee and candles. Therewith, he was permitted to retire to the farm, Taaibosch in the Winburg district. VRO 3 ref 1245

“ORC Claims for Compensation” cjc vol 713 ref 796 The documents pertain to a claim J A Kotzee lodged on behalf of his father, P J Kotzee (of the farm Kareeboomfontein in the district of Winburg) for losses incurred and/or damages suffered when the British Columns invaded the farm of P J Kotzee e.g. house destroyed, loads of wood taken, horses and cattle killed (or taken). There are detailed statements and inventories on what his father claimed.

CHO Marais was appointed as first resident editor of the Onze Courant of Graaff-Reinet in 1894. Known for not always choosing his words carefully, he was active in the Afrikaner Bond at the outbreak of the Anglo-Boer War, and labelled one of the town “undesirables” for his support of the then Boer Republics and “sent” to Port Alfred. He was living in Humansdorp whence he was admitted to Provincial Hospital prior to his death in 1914.

Dr C H Marais and J N M van Mameren were married in Holland. She was the daughter of a university professor and hailed from Amsterdam. On returning to South Africa in October 1919, Marais bought a practice in Murraysburg. Their first born was a son, six months old when he died suddenly whilst his father was “on district”. The couple left Murraysburg and went to Koffyfontein. Confinements were extremely difficult for her. She gave birth to a further two children, is thought to have suffered puerperal depression; and committed suicide by drinking poison and jumping into the local river. He brought his mother, Ouma Marais/Albertyn from Humansdorp to care for the children. Depressed, he turned to alcohol; sustained a severe motorcar accident and was admitted to Kimberley Hospital. Here, on a Christmas Day, he met Hildegaard Pauline Jane Oertel, earning from her the nick-name Noël in the process. During the 1939-1945 war, the family moved to Robert’s Heights, Pretoria, and remained there. Ouma Marais/Albertyn died in Krugersdorp.
